Terms of Service

How Cerium is provided: who the provider is, what the subscription covers and what both parties commit to.

Effective from 14.10.2026

1. General provisions

These terms govern the use of Cerium, a school management system provided as a subscription service at cerium-app.com. The provider is IT Maciej Bodnar, tax ID (NIP) 5243050733, operating under the fire-gem brand. Contact: [email protected].

2. Definitions

School means a business, institution or natural person, including one without a registered business (for example a private tutor), that concludes an agreement with the provider to use Cerium (the Agreement). Consumer means a School that is a natural person concluding the Agreement for purposes not directly related to their business or profession. User means a person the School has granted access to: an owner, methodologist, teacher, receptionist, student or guardian. Workspace means the separated area of the system holding one School's data. Plan means the set of limits and the price set for the School under the price list or individually.

3. Agreement and access

The School creates a trial account itself, through the website form, for 14 days; after that period access closes until a plan is chosen. The provider may also create the workspace and the owner's account after an order placed by e-mail. The Agreement is concluded when the owner accepts it in the panel or, when the owner chooses a plan on their own, when the subscription starts after the payment button is clicked, as the panel states next to that button; we then record the name, e-mail address, IP address, time of acceptance and a copy of the accepted text as proof. The School grants further access to its users and is responsible for the actions of the people it grants access to.

4. User accounts

An account belongs to the person, not to the School: the same account may have access to several schools, and only its holder changes the password, name, e-mail address and language. The School grants and withdraws access to its workspace but never sees the password; withdrawing access signs the person out immediately. An account with access to no school that has not been used for 180 days is deleted.

5. Scope of the service

The subscription covers Cerium modules within the limits of the Plan (for example the number of students and teachers, file storage and online lesson minutes). A hard limit stops the write, a soft one accepts it and records the excess. The School may switch off modules it does not use. Modules marked as beta work but may still change. The provider keeps developing the system and may change its appearance and feature set without materially reducing the functionality of a paid Plan.

6. Technical requirements

Using Cerium requires an up-to-date browser (Chrome, Edge, Firefox or Safari) with JavaScript and cookies enabled, and an internet connection. Online lessons require a camera and microphone and the browser's permission to use them. Nothing has to be installed.

7. Demo workspace

Before the Agreement is concluded, the School may use a demo workspace for 14 days from the creation of the account, without a card and without obligations. The demo is for trying the system, so real student data must not be entered in it; access closes automatically after that time unless the School concludes the Agreement. Free months, if agreed, are set out in the Agreement.

8. Fees

Prices are quoted net and VAT is added: in Polish złoty for a workspace created from the Polish version of the site, in euro for one created from any other version; the currency is set when the workspace is created and does not change after the first invoice. The subscription is paid in advance for each period, as a rule automatically from a card the School saves with the payment operator Stripe; the School manages the card and invoices in Settings. Students and teachers above the Plan are added to the next invoice. On online payments the School accepts from its own clients through its own Stripe account we charge the commission set in the Agreement. If payment is not made within 7 days of the due date, access to the workspace may be suspended until the balance is settled. Price list changes are announced at least 30 days in advance and do not affect a period already paid for.

9. School obligations

The School uses the system lawfully, enters only data it is entitled to hold and informs its users about the processing of their data. Providing unlawful content, including in files, messages and the School's public pages, sharing accounts with people outside the School, circumventing Plan limits and putting load on the system beyond normal use are prohibited. Our point of contact, including for authorities and for reporting unlawful content, is [email protected]; we correspond in Polish and English.

10. School data

Data entered by the School (students, guardians, staff, finances, files) belongs to the School, which remains its controller. The provider processes it solely to deliver the service, as a processor under the data processing terms of the Agreement; an extended data processing agreement is available on request. Accounts of students, including minors, and of guardians are created only by the School, which is responsible for the legal basis for processing their data. The providers we use to deliver the service are listed in the Privacy Policy.

11. The School's public pages

The School may publish pages that need no sign-in under our domain: an enrolment form, a survey, a placement test, a booking page, a payment link or a link to a contract, report or certificate. The School sets the content of such a page and the consent text and is the controller of the data collected there; consent is saved together with a copy of the text the person saw. A person using such a page does not enter into an agreement with the provider.

12. Availability and support

The provider makes every effort to keep the system available around the clock but does not guarantee uninterrupted operation. Outages longer than one hour are announced at least a day in advance in the panel or by e-mail; urgent work, including security work, may happen without notice. Support is provided by e-mail and through the Support form in the panel on business days, 9:00-17:00. Each request gets a priority based on its impact on the School's work, and the response time is at most: 4 hours when the system is down for everyone, 1 business day when an important feature does not work, 3 business days for a bug with a workaround and 5 business days for a question.

13. Complaints

The School files a complaint about the operation of the system or billing by e-mail to [email protected] or through the Support form in the panel, stating the workspace, the problem and the expected solution. We reply by e-mail within 14 days. If a business's complaint needs longer investigation, we say so before the deadline and give a new one of no more than a further 14 days; a Consumer's complaint is always handled within 14 days, and no reply within that time means it is accepted.

14. Liability

The provider is liable only for damage caused wilfully or through gross negligence, up to the fees paid by the School for the 3 months preceding the event. The provider is not liable for lost profits, the consequences of incorrect data entered by the School, the operation of third-party services such as the payment operator, or outages caused by force majeure. These limits do not apply where mandatory law excludes them, in particular towards a Consumer.

15. Term and termination

The Agreement is concluded for an indefinite period. The School may terminate it at any time in the panel or by e-mail, effective at the end of the paid period; the provider with one month's notice. During the Agreement the School downloads its data itself (CSV export from tables, documents and files). After termination access is blocked and the data is kept for 90 days so it can be handed over at the School's request; it is then permanently deleted and leaves the backups within a further 14 days.

16. Consumers

A Consumer may withdraw from the Agreement without giving a reason within 14 days of its conclusion by writing to [email protected]. If, before that period ends, the Consumer expressly requests the service to start and begins using it, after withdrawal they pay only for the time up to the withdrawal. A person running a business for whom the Agreement is not of a professional nature has the same rights. A Consumer may use out-of-court dispute resolution, for example the help of a municipal or district consumer ombudsman or the regional Trade Inspection office; information is available at polubowne.uokik.gov.pl.

17. Changes to the terms and governing law

Changes to these terms are announced by e-mail and on this page 14 days in advance; a change to the Agreement reaches the owner as a new version to accept in the panel. A School that does not accept a change may terminate the Agreement effective at the end of the billing period. Polish law applies. Disputes with a business are settled by the court competent for the provider named in the Agreement, and disputes with a Consumer by the court competent under general rules. In case of conflict between documents the Agreement prevails.
